Uganda Law Society president, Isaac Ssemakadde has been dragged to court for expelling the Attorney General Kiryowa Kiwanuka and the Solicitor General from the law society council.
Ssemakadde in an executive order on Monday that the two ex officio positions on the ULS Council are a colonial hangover and incompatible with the radical new bar’s autonomy.
However, the legal rebel seems to be facing his own music after another lawyer, Robert Rutaro dragged him to the civil division of the High Court challenging the expulsion.
The lawyer says the executive order by Ssemakadde is null, void ,tainted with illegality and irrational.
“The respondents( Ssemakadde and ULS) have no authority or power the Attorney General of the Republic of Uganda, the Solicitor General or their representatives from the Uganda Law Society council thereby rendering their impugned order arbitrary,” Rutaro says.
The lawyer avers that the Attorney General and Solicitor General are permanent members of the Uganda Law Society Council in accordance with the Uganda Law Society Act and that expelling them can only be done through amendment of the said act.
He argues that the due process was not followed by the Uganda Law Society president before coming up with his decision to expel the Attorney General and Solicitor General from the law society council, noting that this means everything was done illegally .
“The composition of the Uganda Law Society council is a creature of the statute and therefore cannot be altered by mere wishful thinking of Isaac Ssemakadde.”
According to the lawyer, the Uganda Law Society president wants to use his position to settle personal scores, revenge and shame Kiryowa Kiwanuka which is an embarrassment to Uganda Law Society and all its members including Rutaro that he says cant be allowed to happen.
“Isaac Ssemakadde is currently facing criminal charges at Buganda Road Court for being a public nuisance and therefore if not restrained urgently, no one is safe, including the president of Uganda, and all national leaders who risk being ridiculed, ashamed , insulted and mocked by him.”
Orders
Lawyer Rutaro now wants court to issue an order quashing Ssemakadde’s executive order and restraining him and the Uganda Law Society from ever attempting again to expel the Attorney General and Solicitor General or their representatives from the Uganda Law Society council.
