Nakawa Chief Magistrates Court has ordered for the arrest Martha Nkwanzi, the daughter of murdered businessman, Henry Katanga.
Chief Magistrate Erias Kakooza issued the arrest warrant on Monday after the defence lawyers failed to give a satisfying reason for failure by Nkwanzi to appear in court after criminal summons were issued against her.
When three of the five accused persons including Patricia Kakwenza, Dr Charles Otai and George Amanyire appeared in court for mention of the case, prosecution led by Jonathan Muwaganya asked court to issue a warrant of arrest against Nkwanzi and her mother, Molly Katanga.
Defence lawyers including Jet Tumwebaze, Mac Dusman Kabega and Bruce Musinguzi told court that Molly Katanga is still undergoing treatment at IHK hospital after undergoing another surgery and that Nkwanzi is still undergoing home post-labor treatment.
Medical documents and a report from both hospitals were tendered to court as well as a report from the ministry of health confirming the health status of Molly Katanga.
However, the prosecutor dismissed as untrue, reports that Nkwanzi is still unwell, noting that she is at home and can ably adhere to court summons.
Reasoning with the prosecution, Chief Magistrate Kakooza issued an arrest warrant against Nkwanzi whom she said is at home and therefore cannot choose to attend court at her own terms.
The chief magistrate however deferred hearing of an application for bail by the three suspects currently on remand after the file case file was called for review by the High Court after complaints by the Director of Public Prosecutions.
The case has been adjourned to January, 22, 2024.
Prosecution alleges that Henry Katanga was shot dead on November, 2, 2023 at Mbuya Chwa 2 road, Nakawa Division- Kampala Capital City by his 55 year old wife Molly Katanga .
On the side side, the daughters Nkwanzi Martha Katanga and Kakwanza Patricia are accused of knowing that diverse things at the scene of crime maybe required in evidence in a judicial proceeding, but removed or destroyed them and thus rendered them illegible for identification.
Prosecution further alleges that Amanyire George , and Otai Charles received or assisted other people who were to their knowledge liable of an offence, in order to enable them escape punishment.
