Court has issued fresh summons against Molly Katanga to answer charges of the murder of her husband, Henry Katanga.
The presiding Chief Magistrate, Erias Kakooza was on Monday told that Molly Katanga and her daughter, Martha Nkwanzi Katanga were not able to come to court despite earlier criminal summons against them.
The duo’s lawyers including Elison Karuhanga , Jet Tumwebaze and Bruce Musinguzi told court that Molly Katanga was advised to be kept under the doctor’s watch due to severe head and brain injuries and a hand fracture she suffered.
The lawyers presented a letter and still pictures explaining that she was operated upon for those injuries and not yet stable to attend court as she is still admitted at IHK in Namuwongo.
The lawyers also told that her daughter Martha Nkwanzi has just given birth and suffers from post-partum effects for which doctors at Roswell hospital recommended that she needs close supervision.
The lawyers however told court that as soon as the duo gets well, they will be presented to court.
Chief Magistrate Kakooza consequently extended the criminal summons against the two and asked that they appear in court on January, 8, 2024.
Prosecution alleges that with malice aforethought, Molly Katanga killed Henry Katanga.
The daughter Martha Nkwanzi is accused of destroying evidence related to the murder.
The state prosecutor, Mariam Kuruthum told court on Monday that investigations into the murder of Katanga are still ongoing .
The same court also declined to hear a bail application by the three other accused persons after advising them to apply for the same in the High Court which has jurisdiction to handle such capital offences.
The three accused persons currently on remand are Kakwanza Patricia, deceased’s daughter accused of destroying evidence, Amanyire George,a shamba boy and Otai Charles a health worker who are on charges of accessory after the fact of murder were further remanded .
Prosecution alleges that Henry Katanga was shot dead on November, 2, 2023 at Mbuya Chwa 2 road, Nakawa Division- Kampala Capital City by his 55 year old wife Molly Katanga .
On the other side, her daughters Nkwanzi Martha Katanga , a student residing at Mbuya and Kakwanza Patricia, a business woman residing at Mbuya, removed or destroyed evidence at the murder scene and thus rendered it illegible for identification.
Prosecution further states that Amanyire George , and Otai Charles received or assisted other people who were to their knowledge liable of an offence, in order to enable them escape punishment.
At court on Monday, the deceased’s relatives carried placards demanding for justice.
