A man describing himself as a concerned citizen has sued government over its planned move to relocate Luzira Prisons and replace it with a five star hotel.
President Museveni in 2022 okayed the idea , allowing a Chinese investor of Tian Tang Group to construct a five star hotel and relocate the maximum security prison to another area.
Buikwe has been proposed to house the prison.
However, one Deus Arinaitwe has run to the Civil Division of the High Court in Kampala suing both the Attorney General and Tian Tang Group Holdings Limited over the move.
He says the actions of the president to direct the give away of Luzira Prisons land and the construction of a five-star hotel by Tian Tang Group are illegal and violate the Ugandan constitution.
“The president is not mandated under the law to direct the acquisition of land , and in this case, land on which a public institution, Luzira Prison is sitting. The president doesn’t have legal mandate to mandatorily direct for the acquisition of land, his actions directing for the acquisition of the land by Tian Tang Group are a contravention of Article 26 of the Constitution,” Arinaitwe says.
He avers that the procedure adopted by the Chinese Group to takeover Luzira prison land is a gross violation of the laws relating to land acquisition and in contravention of rights to property .
“The second respondent(Tian Tang Group) adopted means that essentially were coercing and unfairly influencing the acquisition of the said land.”
The concerned citizen says the ongoing negotiations by the Minister of Internal Affairs in regards the relocation of the prison to another area are illegal as he and the president are not mandated to do any sort of bidding for private persons to acquire property.
Arinaitwe now wants court to issue a permanent injunction stopping negotiations and any activity related to giving away Luzira land and relocating the prison .
He also wants to stop the proposed construction of a five start hotel at Luzira.
