The Court of Appeal has dismissed an application in which the Uganda Muslim Supreme Court sought to block the impending sale of Muslim property including the headquarter building in Old Kampala which also houses Gadaffi mosque over a shs19 billion debt.
On Wednesday morning, Justice Christopher Gashirabake threw out the application saying UMSC has failed to prove that it has a likelihood of success in the pending appeal or that it will suffer any damage or harm that cannot be atoned by an award of damages.
“Clearly, the balance of convenience would be in not granting this application for stay of execution but to allow the party with the judgment in hand to proceed with the execution process. Consequently, for the reasons I have given above, this application is dismissed,” Justice Gaashirabake ruled.
The development means that if Uganda Muslim Supreme Council doesn’t pay businessman, Justus Kyabahwa shs19 billion by December, 24, 2023, they will lose property including their headquarters at Old Kampala.
